Terms and conditions
The Terms and Conditions (“T&Cs”) for the use of the Cumbria Card provide a clear framework for administration, issue and use of the card and apply to all students (“Students”) registered at the University of Cumbria (“the University”) irrespective of mode of delivery and location. Initially the three main areas where the Cumbria Card will be used are Facilities Management, Learning, Information and Student Services (LISS), and Student Administration.
The T&Cs operate within the University Regulatory Framework and in conjunction with the Student Regulations, with reference to the Student Code of Conduct & Adjudication Process and the Academic Regulations. The Regulations also comply with current Data Protection legislation.
Upon using his/her Cumbria Card a Student will be deemed to have accepted these T&Cs.
1. Use of the Cumbria Card

Students may use their Cumbria Card for the following University services:

to borrow items from any the University’s Libraries and the Learning Gateway;

to print and photocopy in University libraries, using pre-loaded credit;

to pay for meals and non-alcoholic drinks in the restaurants and cafes in any University catering outlet where applicable, using money previously loaded onto their account.

to identify yourself as a student to receive VAT free purchases at any till: and
-
as an identification card (which must be presented at all exams).

The Cumbria Card is not covered by the Consumer Credit Act 1974 and these terms do not entitle Students to any purpose other than stated in 1.i, above. The Cumbria Card is not a credit card and all use is limited to the amount of pre-loaded and standing credit on it and any other limits referred to in these T&Cs.

There is no interest payable to Students on the credit balance of the Cumbria Card and it does not amount to a deposit with the University.

Students are solely responsible for the management of the credit balance on their Cumbria Card.

Students must carry their Cumbria Card at all times when on University property and must produce the Cumbria Card at the reasonable request of a University official.
2. Loss, theft or misuse of the Cumbria Card

Students must take all reasonable precautions to prevent loss, theft or misuse of their Cumbria Card.

Students must never knowingly attempt to use their Cumbria Card in any device which has not been approved for the purpose of the Cumbria Card.

Students must not lend their Cumbria Card to anyone to allow them to gain unauthorised access to University facilities.

If a Cumbria Card is lost, stolen or otherwise liable to be misused, Students must co-operate and provide reasonable assistance to the University, the Police and any other persons or bodies the University reasonably directs them to. If a Student can produce a crime number in respect of a lost or stolen Cumbria Card then there will be no charge for a replacement.

Any losses incurred as a result of the Cumbria Card being lost, stolen or misused shall be borne solely by the cardholder. The University shall bear no responsibility, financial or otherwise, except to the extent that it is proved to have acted negligently in respect of that loss.

Whenever a Cumbria Card is used, it shall be presumed that the transaction has been undertaken by the rightful owner in all circumstances.

Cumbria Card being lost or stolen, LISS and the Catering Administration Office must be informed immediately. The Student shall be liable for all losses incurred up to the point in time that the loss is reported.

in circumstances where a Cumbria Card has been lost or stolen, a replacement will be issued by LISS at a cost of £5 payable by the Student.

Replacement Cumbria Cards must be taken to the Catering Administration Office to have the catering account re-associated, for which a further charge of £5 will be payable by the Student.
3. Faulty/Damaged Cards

Students must take all reasonable precautions to ensure the Cumbria Card does not become damaged.

All Cumbria Cards remain the property of the University at all times.
4. Unforeseeable events

The University shall not be liable for any delay or non-performance of these T&Cs arising from any cause beyond its reasonable control, including, but not limited to, any of the following: acts of God, government act, war, fire, flood, telecommunication breakdown, loss of power, explosion, accident, civil commotion, industrial dispute or impossibility of obtaining materials.
5. Problems with cards or equipment

Students must co-operate fully with the University in order to resolve any problems relating to the Cumbria Card that may arise.
6. Evidence
-
In the event of a dispute, the University may rely fully on the data held on the Cumbria Card or associated account and related hardware as conclusive evidence of transaction history.

The University may also rely on any data on the Cumbria Card as conclusive evidence of the matters recorded in them and that the transactions described by them actually occurred.
7. Disclosure of information

The University may share information held on Cumbria Cards and related hardware concerning Students and their use of the Cumbria Card with appointed agents:

to provide Students with the service applied for; or
-
to help resolve a complaint, for analysis and/or management information; or
-
for purposes of fraud prevention, audit or debt collection; or
-
other cardholders,
but only where it is considered necessary for resolution of fraud or dispute, which will be done in accordance with the current Data Protection legislation.
8. Termination or suspension

Where it is considered that there are reasonable grounds for doing so, the University may suspend or terminate the use of a Cumbria Card at any time without prior notice.

The University reserves the right to withdraw all Cumbria Cards, suspend some or all of the services related to them or replace the Cumbria Cards with one or more alternatives at any time and without prior notice to Students.
9. Card Issue

All Students will be issued with a Cumbria Card

In the event of a change of circumstances, eg course transfer, Students may keep their Cumbria Card for future use.

If Students withdraw from the University then they must return their Cumbria Card to LISS immediately.

Pre-Paid Catered Students shall have an additional separate purse applied to their Cumbria Card. These funds will be applied over the academic year as defined in their accommodation contract of at least £100.00 per month dependant on the pre paid plan as defined in your contract. Any unused credit at July 31st of that year will be non-refundable.

Photocopying and Catering purses are not transferable.

Photocopying funds are non refundable.
10. Additional conditions
Nothing in these T&Cs will confer on any third party any benefit under, or the right to enforce, any of these T&Cs.

The University may assign any of its rights and obligations under these T&Cs to any other person or business, subject to such party continuing the obligations in these T&Cs.

These T&Cs will be subject to the jurisdiction of the courts, and construed in accordance with the laws, of England and Wales.
